By accessing or using RecitalGenius ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

RecitalGenius is a web application designed for music teachers and studio owners to manage students, create recital programs, generate trading cards, and share performance information with families and attendees.

3. User Accounts

3.1 Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

4. Subscription Plans and Billing

4.1 Plans

RecitalGenius offers Free, Studio, and Professional subscription plans with different student limits and features. Plan details are available on our pricing page.

4.2 Billing

• Paid subscriptions are billed monthly via Stripe
• You authorize us to charge your payment method for recurring subscription fees
• Subscription fees are non-refundable except as required by law
• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period

4.3 Trading Card Orders

• Physical trading card orders are separate from subscriptions
• Prices are displayed before purchase and include printing and shipping
• Orders are fulfilled by third-party print providers
• Refunds for defective or damaged cards are subject to the print provider's policy

5. User Content and Responsibilities

5.1 Your Content

You retain ownership of all content you upload to RecitalGenius, including student photos, performance information, and recital details. By using the Service, you grant us a license to use, store, and display your content solely for the purpose of operating the Service.

5.2 Content Responsibilities

You are solely responsible for:

• Obtaining necessary permissions and consents before uploading student photos or information
• Ensuring you have the right to use all uploaded content
• Ensuring content does not violate any laws, regulations, or third-party rights
• Complying with applicable privacy laws (COPPA, GDPR, etc.) when collecting student information

5.3 Prohibited Content

You may not upload content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Violates intellectual property rights
• Contains viruses or malicious code
• Impersonates any person or entity

6. Published Recitals

When you publish a recital program, you make it publicly accessible via a unique URL. You acknowledge that published information (student names, photos, performance details) will be visible to anyone with the link. You may unpublish programs at any time to remove public access.

7. Intellectual Property

7.1 RecitalGenius Property

The Service, including its design, features, and functionality, is owned by RecitalGenius and is protected by copyright, trademark, and other intellectual property laws.

7.2 Themes and Templates

Themes and program templates provided by RecitalGenius are licensed for use within the Service only. You may not extract, reproduce, or use them outside of RecitalGenius.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECITALGENIUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9.3 Third-Party Services

We are not responsible for the performance, availability, or actions of third-party services such as payment processors, print providers, or hosting services.

10. Indemnification

You agree to indemnify and hold harmless RecitalGenius from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which RecitalGenius is operated, without regard to conflict of law principles.
